Statutory entitlement is 5.6 weeks a year, capped at 28 days. Bank holidays can be included in this.

How it works

  • Full and part-time workers: days (or shifts) worked per week × 5.6, capped at 28 days.
  • Hours: hours worked per week × 5.6.
  • Irregular-hours and part-year workers: 12.07% of hours worked in each pay period.
  • Starters and leavers: entitlement is pro-rated for the part of the leave year they're employed.

Important considerations

  • Your contract may give more than the statutory minimum. Always check what's been agreed.
  • Part-time workers must not be treated less favourably. Bank holidays should be pro-rated fairly.
  • When someone leaves, any accrued but untaken holiday must be paid.
  • Round up part-days where your policy allows. You can't round down statutory entitlement.
